Also heard Mr. Bhaskar Sharma, learned Additional Public Prosecutor, Assam. By this application filed under Section 482 of the BNSS, 2023 the petitioner, namely, Sodip Choudhury, has prayed for pre-arrest bail in connection with Dispur P.S. Case No. 25/2026. The informant is sales girl working in a shop. She lives alone in a rented house. The petitioner is a shopkeeper, who has a shop near the shop of the informant. Page No.# 2/2 It is alleged that on 14.01.2026, the petitioner had entered into the house of the girl aforesaid and committed rape upon her. He has allegedly taken away a pair of gold ear rings and Rs.25,000/- cash from her. In her statement, recorded under Section 183 of the BNSS, 2023 the victim girl has implicated the petitioner but the Medical Report does not support her case. The victim girl and the petitioner are major. In view of the above, this Court is of the opinion that the petitioner does not deserve to be detained in custody. Accordingly, it is hereby directed that in the event of arrest of the petitioner Sodip Choudhury in connection with Dispur P.S. Case No. 25/2026, the arresting authority shall release him on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the arresting authority. The petitioner is directed to appear before the Investigating Officer within 10 (ten) days from today. The bail application is disposed of. JUDGE Comparing Assistant
