JUSTICE R.K. PATTANAIK Order No. ORDER 09.07.2026 02. 1. Heard learned counsel for the petitioner and learned ASC for the State. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Talcher P.S. Case No.203 of 2026 corresponding to Special G.R. Case No.10 of 2026 pending in the file of learned Additional Sessions Judge-cum-Special Judge under SC/ST Act, Talcher on the grounds stated therein. 3. Perused the FIR as at Annexure-1. It is informed to the Court by learned counsel for the petitioner that the case is turned to one under Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Recording such submission, this Court is inclined to direct the petitioner to surrender before the learned Additional Sessions Judge-cum-Special Judge under SC/ST Act, Talcher seeking regular bail to be dealt with in terms of decision in Pramod Kumar Ray and others Vrs. State of Odisha (2017) 67 OCR 309. 4. Accordingly, it is ordered. 5. In the result, ABLAPL stands disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned Additional Sessions Judge-cum-Special Judge under SC/ST Act, Talcher within a period of fifteen days from today in connection with Talcher P.S. Case No.203 of 2026 corresponding to Special G.R. Case No.10 of 2026 and moves an application seeking bail, it shall be entertained and disposed of in terms of the decision in Pramod Kumar Ray (supra) and till such time, no coercive action shall be taken against the petitioner. 6.
