JUSTICE R.K. PATTANAIK Order No. ORDER 09.07.2026 01. 1. Heard learned counsel for the petitioner and learned ASC for the State. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Capital P.S. Case No.471 of 2023 corresponding to C.T. Case No.1262 of 2023 pending in the file of learned S.D.J.M., Bhubaneswar on the grounds stated therein. 3. Perused the FIR as at Annexure-1. The details of the allegations are revealed in the report. Learned counsel for the petitioner submits that the present accused is not chargesheeted though investigation is kept open under Section 173(8) Cr.P.C. The case diary is submitted along with the chargesheet by Mr. Panda, learned ASC for the State. The chargesheet reveals that three accused persons have been arrested and forwarded to the court below in connection with Capital P.S. Case No.436 of 2026. In fact, the petitioner is not a chargesheeted. So far as the case at hand is concerned, a preliminary chargesheet is filed, as informed to the Court by the learned counsel for the petitioner, a copy of which is produced at the time of hearing. On perusal of the preliminary chargesheet, it is revealed that the other accused persons have been roped in keeping the investigation open. Nothing is revealed from the preliminary chargesheet as to why the petitioner has not been framed. It is informed to the Court that the petitioner has one more antecedent. Considering the filing of preliminary chargesheet without the petitioner and recording the objection of the State, this Court though not in favour of considering his bail plea, is inclined to direct him to surrender before the learned court below for being released with suitable conditions imposed and accordingly, it is ordered. 4. In the result, the ABLAPL stands disposed of. It is directed that in the event, the petitioner surrenders before the learned S.D.J.M., Bhubaneswar in connection with Capital P.S. Case No.471 of 2023 corresponding to C.T. Case No.1262 of 2023 within a period of fifteen days from today, he shall be released on bail subject to him furnishing a bail bond of Rs.50,000/- (Rupees fifty thousand) with one solvent surety for the like amount to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, to cooperate the I.O. in the investigation without default and attend the P.S. as an when summoned. 5.
