JUSTICE E.S.INDIRESH ORAL ORDER 1. Heard learned counsel appearing for the parties. 2. In this Writ Petition, petitioners are assailing the order dated 09.10.2023 in Rev. Appeal No.701/2012 (Annexure-K) passed by the Karnataka Appellate Tribunal. 3. It is argued by learned counsel appearing for the petitioners that grievance of the petitioners herein was only in respect of 20 guntas of land as regularisation was sought by petitioners' grandmother to that extent, however, the same is contrary to Annexure-B and B1 and accordingly, sought for interference of this Court on the ground that the Karnataka Appellate Tribunal has wrongly arrived at the conclusion to dismiss the claim made by the petitioners herein. 4. Per contra, learned Additional Government Advocate sought to justify the impugned order. - 4 - HC-KAR NC: 2026:KHC:31299 WP No. 6245 of 2024 5. In the light of the submissions made by the learned counsel appearing for the parties, on careful consideration of the writ papers would indicate that grandmother of the petitioner was unauthorisedly cultivating 2 acres of land in Sy.No.18 situated at Konasandra Village, Harohalli Hobli, then Kanakapura Taluk and as such, an order was passed on 09.04.1965 by respondent No.3 to evict the grandfather from the land in question. In this regard, on perusal of the finding recorded by the authorities would indicate that the grandfather of the petitioner had requested for a direction to respondent No.2 to consider the claim for grant of additional extent of 1 acre 20 guntas and by looking into the Writ papers it is seen that father of the petitioner himself has stated that he was in continuous possession and enjoyment of land to an extent of 20 guntas of land in Sy.No.18 of Konasandra village, Harohalli Hobli, Kanakapura Taluk. 6. In that view of the matter, I am of the view that, respondent - authorities were justified in declining to accept the claim made by the petitioner for additional grant of 1 acre of land on the sole ground that what is claimed by father of the - 5 - HC-KAR NC: 2026:KHC:31299 WP No. 6245 of 2024 petitioner is only to an extent of 20 guntas in which he was cultivating and accordingly, no interference is called for in this Writ Petition. 7.
