Order No. 04
Dated 01st April, 2026
Heard the learned counsel appearing for the respective parties.
Since both these applications arise out of a common F.I.R., they are being
disposed of by this common order.
The petitioners are accused in connection with Pandwa P.S. Case No. 86 of
2025.
It has been alleged that a Scorpio vehicle was intercepted by the police and the petitioners were apprehended. From inside the vehicle 1.49 kg. of Ganja kept in a sack was recovered.
Submission has been advanced by the learned senior counsel for the petitioners that the recovered quantity of Ganja from the vehicle is an intermediary quantity. It has further been submitted that the petitioners are in custody since
18.11.2025. Learned senior counsel adds that the petitioner in B.A. No. 604 of 2026 has three criminal antecedents, but the same does not relate to NDPS Act. So far as the petitioner in B.A. No. 744 of 2026 is concerned, he does not have any criminal antecedent.
Regard being had to the fact that an intermediary quantity of Ganja was recovered, both the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, NDPS Act, Palamau in connection with Pandwa P.S. Case No. 86 of 2025.
