……for the Air Customs Authority. Learned advocate appearing for the petitioners submit that petitioners have been intercepted at the Calcutta Air Port with alleged recovery of 998 grams and 1 kg of ganja respectively. Petitioners are in custody for more than three months, complaint has already been filed before the learned jurisdictional Court, as such the petitioners may be released on bail. Learned advocate appearing for the Air Customs Authority opposes the prayer for bail. I have taken into account the quantum of seizure and the judgment of the Hon’ble Supreme court in Barnali Bag –Vs. – Union of India [SLP (Crl.) 3641/2026]. Having considered that the emphasis of the Hon’ble Supreme Court was on intermediate quantity, I am inclined to release the petitioners on bail. Accordingly, the prayer for bail of the petitioners is allowed. 2 As such, the petitioners, namely, Jashanpreet Kaur and Komal Kaur shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Barasat, North 24 Parganas. If on bail, the petitioners shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of North 24 Parganas without prior permission of the learned Special Court. Additionally, petitioners shall make themselves available at an address and furnished the address to the investigating officer of the case. The investigating officer of the case would be at liberty to cross-check by way of surprise visit at the address furnished by the petitioners, as and when it appeals to the investigating officer of the case. With the aforesaid observations, CRM (NDPS) No. 1050 of 2026 is allowed.
