ORAL ORDER
1. Accused No.5 in SC No.5/2025 pending before the Court of III Additional District and Sessions Judge, Ramanagara, arising out of Crime No.190/2022 registered by Channapatna Rural Police Station, Ramanagara, for the offences punishable under Sections 399 and 402 of IPC, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.
2. Heard the learned counsel for the parties.

Learned counsel for the petitioner submits that on the merits of the case, petitioner, who was earlier arrested in the present case was granted regular bail. Only for the reason that he had not appeared before the Trial Court, he was arrested and remanded to judicial custody on 06.03.2025. After the year 2022, petitioner has not involved himself in any other criminal case. He is ready and willing to abide by the conditions that may be imposed upon him by this Court. Accordingly, he prays to allow the petition. - 3 -

Per contra, learned HCGP, who has opposed the petition submits that petitioner is a person with criminal antecedents and after he was released on bail in the present case, he had not appeared before the Trial Court. Accordingly, he prays to dismiss the petition. 5. Petitioner, who was earlier arrested in the present case, undisputedly, has been granted regular bail in the present case vide order dated 23.01.2023 passed in Crl.Misc.No.37/2023 by the jurisdictional Sessions Court. It appears that for the reason that petitioner had not appeared before the Trial Court on regular dates of hearing, coercive steps were taken against him and his presence was secured on 06.03.2025 and on the said day, he was remanded to judicial custody. The submission made by learned counsel for the petitioner that in the earlier four criminal cases registered against the petitioner, he has been enlarged on bail, is not seriously disputed by learned HCGP. It is also not in dispute that petitioner has not involved himself in any other case after the year 2022. Insofar as the present case is concerned, for the mistake committed by the petitioner by not appearing before the Trial Court on the

regular dates of hearing, he has been sufficiently punished. Under the circumstances, I am of the opinion that his prayer for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:-
6. The petition is allowed.
The petitioner is directed to be enlarged on bail in SC No.5/2025 pending before the Court of III Additional District and Sessions Judge, Ramanagara, arising out of Crime No.190/2022 registered by Channapatna Rural Police Station, Ramanagara, for the offences punishable under Sections 399 and 402 of IPC, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
