INDIRESH ORAL ORDER In this petition, the petitioner is challenging the Endorsement dated 07th March, 2022 (Annexure-J) issued by the respondent No.2, rejecting the application of the petitioner for change of RTC and other revenue entries in his favour in respect of the land in question; inter alia sought for a direction to the respondent No.2 to effect revenue entries in the name of the petitioner in respect of the land in question. 2. Heard Sri. Ajith N., learned counsel appearing for the petitioner and Sri. Ajith N., learned counsel appearing for the petitioner, by referring to the re-grant order dated 28th January, 1982 (Annexure-A) and the proceedings in Case No. LRM.INA.44/1981-82 on the file of the Land Tribunal, Sira, Tumakuru District, argued that the land has been re-granted in favour of the father of the petitioner viz., B.R. Srinivasa Rao. Accordingly, he sought for interference of this Court. 4. Sri. Spoorthy Hegde N., learned High Court Government Pleader appearing for respondents sought to justify the impugned endorsement issued by the respondent No.2-Tahsildar. 5. Having heard the learned counsel appearing for the parties, taking into consideration the order of re-grant dated 28th January, 1982 (Annexure-A) and the proceedings in LRM/INA.44/1981-82 on the file of the Land Tribunal, Sira, Tumakuru District, I am of the considered opinion that the respondent No.2 has committed an error in issuing the impugned endorsement stating that the land in question stands in the name of Sri. Someshwaraswamy Temple. Therefore, the - 4 - HC-KAR NC: 2026:KHC:31795 WP NO.12620 OF 2022 same has to be reconsidered by the respondent No.2. Accordingly, I pass the following: O R D E R (i) Writ Petition allowed; (ii) Endorsement dated 07th March, 2022 (Annexure-J) issued by the respondent No.2 is hereby set-aside, and the matter is remitted to the respondent No.2-Tahsildar with a direction to reconsider the issue afresh taking into account the order of re-grant dated 28th January, 1982 (Annexure-A) and the proceedings before the Land Tribunal, Sira, Tumakuru District in Case No.LRM.INA.44/1981-82 and pass appropriate orders; (iii) The respondent No.2-Tahsildar is directed to reconsider the issue on merits and pass appropriate orders within a period of four months from the date of receipt of this order.
