JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question proceedings in C.C.No.61599/2025, pending before the XI Addl. Chief Judicial Magistrate at Bengaluru, registered for the offences under Section 85 of BNS, 2023 and Sections 3 and 4 of the Dowry Prohibition Act. - 3 - HC-KAR NC: 2026:KHC:32757 CRL.P No. 8828 of 2026 2. Heard Sri.Sanjeev Hegde, learned counsel appearing for the petitioners, Smt.Rashmi Patel, learned HCGP appearing for respondent No.1, Sri.Mohamed Zulfikhar Ahmed, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Joint Memo in that regard. The joint memo reads as follows: “1. That the parties to the above proceedings have amicably settled the disputes and differences arising out of the subject matter of the Criminal case bearing C.C. No.:61599/2025 (Crime No.0198/2024) of the East Women P S registered for the offence punishable U/Sec. 85 of BNSS and U/Sec 4 of DP Act 1961, which is now pending on the file of the Court of XI ADDL. Chief Judicial Magistrate, Mayo Hall at Bengaluru. 2. It is submitted that the parties have entered into full and final Settlement dated: 01.07.2026, whereby all claims and allegations between them have been fully and finally resolved to their mutual satisfaction. The copy of the said Memorandum of Settlement agreement between the parties is attached herewith for the kind reference of this Hon'ble Court. 3. It is humbly submitted that in view of the above said agreement of settlement the Respondent No.2/Complainant has no objection for quashing of the criminal proceedings pending against the Petitioners herein, who are the parties to the Memorandum of Settlement agreement. The parties jointly state that the - 4 - HC-KAR NC: 2026:KHC:32757 CRL.P No. 8828 of 2026 continuation of the criminal proceedings would only lead to further hardship and serve no useful purpose, as the matter has been resolved amicably, voluntarily and without any coercion or undue influence. 4. Wherefore it is prayed that this Hon'ble Court may be pleased to take this Joint Memo along with Memorandum Of Settlement agreement on record and quash the proceedings in C.C.No.61599/2025 (Crime No.0198/2024) of the East Women P S registered for the offence punishable U/Sec. 85 of BNSS and U/Sec 4 of DP Act 1961, which is now pending on the file of the Court of XI ADDL. Chief Judicial Magistrate, Mayo Hall at Bengaluru, in light of the settlement dated: 01.07.2026 in the interest of justice and equity.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of Joint Memo as quoted supra being filed and offences not being against the State, I deem it appropriate to accept the said Joint Memo and terminate the proceedings against the petitioners in the subject petition. 6.
