It is submitted that there was no discrimination so far as considering the petitioner's case for promotion. 2. The written instructions are placed on record and the instructions would indicate that the petitioner's case was also considered by the committee. However, the petitioner was found in eligible and as such was not entitled for promotion as on the relevant date. 3. According to the written instructions, the writ petition is closed, leaving it open for the petitioner to initiate fresh proceedings on arising of any fresh cause of action. No order as to costs.
