Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner indulged in demand of extortion and stopped Volvo truck of the company of the informant and set the said Volvo truck, engaged in coal excavation work, on fire and thereafter, the co-accused leader of the JJMP extremist organisation Shiv Jee, demanded levy of two crores and threatened that if it is not paid, then he will commit bigger crime. It is submitted that the allegation against the petitioner is false. It is next submitted that though the petitioner is not named in the F.I.R. yet without putting him on TIP, as mentioned in para 10 of the Bail Application, chargesheet has been submitted against him. It is also submitted that the co-accused, with similar allegations, has already been admitted to bail by this Court vide order dated 20.08.2026 passed in B.A. No.7428 of 2026. It is next submitted that the petitioner has been in jail custody since 22.05.2026, as mentioned in para-01 of the instant bail
application. It is next submitted by learned counsel for the petitioner that the petitioner is ready and willing to co-operate with the trial of the case and undertakes not to annoy or disturb the informant or the other witness of the case in any manner during trial of the case, hence, the petitioner may be admitted to bail. Learned Addl. P.P. opposed the prayer for bail. Considering submissions of learned counsels and the facts as stated above, I am inclined to release the petitioner on bail. Hence, the court below is directed to release the petitioner on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Chatra in connection with Tandwa P.
