By way of this petition, the petitioner seeks the following reliefs : 10.1 That, this Hon'ble Court may kindly be pleased to after set aside the document (ANNEXURE-P/3), thereafter, declare the petitioner eligible for allotment of house (urban) under the scheme of Pradhan Mantri Awas Yojana Scheme. 10.2 That, the Hon'ble Court may kindly be pleased to direct the respondent authorities to consider the case of the petitioner for allotment of house (urban) under the PMAY Scheme. 10.3 That, the Hon'ble Court may kindly be pleased to direct to consider the pending representation of petitioner, for allotment of house (urban) under the PMAY Scheme. 10.4 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given. 2. Learned counsel for the petitioner submits that earlier, the petitioner had applied for allotment of an EWS house as a 3 landless person. However, upon consideration, the said application was rejected on the ground that the petitioner failed to submit the relevant Domicile Certificate. He submits that at present, the possesses the requisite Domicile Certificate as required under the law by the Municipal Corporation for allotment of an EWS house. As such, he prays that the authorities of the Municipal Corporation, Ambikapur may be directed to reconsider the application of the petitioner for the same. 3. Learned counsel for the Municipal Corporation submits that if the petitioner submits the Domicile Certificate, the case of the petitioner shall be considered in accordance with law, subject to availability of the EWS house. 4. Learned counsel for the State submits that the petitioner ought to file an appropriate application before the competent authority along with all relevant documents to be reconsidered for the allotment of an EWS house. 5. Having heard learned counsel for the parties and having perused the record, this Court deems it appropriate to direct the Municipal Corporation, Ambikapur to reconsider the case of the petitioner. Upon submission of a fresh application along with the requisite Domicile Certificate in accordance with law along with all other relevant documents necessary for the allotment of an EWS house, the Corporation shall consider the said application, subject to the availability of EWS house. Ordered accordingly. 6. The petitioner would be at liberty to file an appropriate application along with the Domicile Certificate and all other relevant 4 documents before the Municipal Corporation, Ambikapur within a period of 15 days from the date of receipt of a certified copy of this order. In turn, on receipt of the said application, the concerned authorities are directed to consider the entitlement of the petitioner in accordance with law, within a further period of 45 days. 7.
