The instant writ application has been preferred by the petitioner(s) praying therein for the following reliefs: i) Issue an appropriate writ/order/direction commanding upon the respondents to forthwith pay the lawful wages/salary and all consequential dues of the petitioner, who has been continuously working as a Part-Time Sweeper (Jhadukash) in the office of the Assistant Public Prosecutor/Public Prosecutor, Pakur since 01.04.2000 without any break, whose engagement and continuous service have repeatedly been acknowledged and certified by the concerned prosecuting authorities themselves through various official communications and representations addressed to the superior authorities, but despite extraction of work for more than 26 years, the petitioner has been paid only meagre amounts on two occasions and has otherwise been denied his lawful wages till date; ii) Issue an appropriate writ/order/direction commanding upon the respondents to calculate and release the entire arrears of wages/salary payable to the petitioner from 01.04.2000 till date along with admissible ( 2026:JHHC:26122 ) interest within a time-bound period; iii) Issue an appropriate writ/order/direction declaring the action/inaction of the respondents in taking continuous work from the petitioner without payment of wages for more than 26 years as arbitrary, illegal, unconstitutional and violative of Articles 14, 21 and 23 of the Constitution of India. 3. Learned counsel for the petitioner submits that since the petitioner is fully entitled for the prayer made in the instant writ application; as such, he submits that this case may be disposed of by giving liberty to the petitioner to file fresh representation before the concerned respondent for redressal of his grievance. 4. Learned counsel for the respondents fairly submits that since no counter affidavit has been filed; as such the petitioner(s) may approach the 2nd respondent for redressal of his grievance. 5. Having regard to the aforesaid submissions and looking to the prayer made in the instant writ application, the same is hereby disposed of by directing the petitioner to approach the 2nd respondent by filing a fresh representation along with all relevant documents. The moment the 2nd respondent receives the representation of petitioner then he will verify the record of the case and pass an appropriate order in accordance with law and applicable rules and regulations within a period of 8 weeks from the date of receipt of such representation. 6. It goes without saying that if the decision is taken in favour of the petitioner, necessary consequential benefits be issued to the petitioner within a further period of 2 weeks.
