... Applicant(s) versus State Of Chhattisgarh Through Station House Officer, Police Station Malkharouda, District Sakti (C.G.)
... Non-applicant(s) For Applicant : None For Non-applicant/State : Mr. Shailendra Sharma, Panel Lawyer. Hon'ble Mr. Ramesh Sinha, Chief Justice Order on Board 07/07/2026
1. None appears nor any representation made on behalf of the applicant to press this bail application when the case is called out. Hence, the Court proceeds to consider and hear the bail application of the applicant with the assistance of the State counsel. 2. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of regular bail to the applicant who has been arrested in connection with Crime No. KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 46/2026 registered at Police Station Malkharouda, District – Sakti (C.G.), for the offence punishable under Section 22(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. Case of the prosecution in brief is that the concerned Police Station, Malkharouda, received secret information that on 02.02.2026, certain persons were illegally possessing prohibited cough syrup for the purpose of sale. Acting upon the said information, the police conducted a raid at the place of occurrence and recovered 09 litres of Onerex Syrup from an open place. During the course of investigation, the present applicant along with other co-accused persons came to be implicated in the alleged offence. Consequently, Crime was registered against them for the offence punishable under Section 21(B) of the NDPS Act. After completion of the investigation, charge-sheet has been filed against the applicant for the aforesaid offence. 4. Learned counsel appearing for the State/non-applicant would oppose the bail application and submit that the charge-sheet has been filed in the present case before the competent Court. He further submits that the quantity of contraband article i.e. 09 litres of Onerex Syrup, a prohibited narcotic substance, was recovered during the course of investigation from the possession of the applicant, is much above the commercial quantity and as such, the applicant is not entitled to be released on bail. 5. I have heard learned counsel appearing for the State and perused the case diary. 3
6.
From perusal of the case diary, it transpires that the contraband article which has been seized from the possession of the applicant, is much above the commercial quantity and the applicant has failed to explain the same and it cannot be a case of false implication, hence, this Court does not find a fit case to release the applicant on regular bail. 7. Accordingly, the bail application of the applicant – Krishna Kumar Jangde filed under Section 483 of the B.N.S.S., involved in Crime No. 46/2026 registered at Police Station Malkharouda, District – Sakti (C.G.), for the offence punishable under Section 22(B) of the Narcotic Drugs and Psychotropic Substances Act, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. - Sd/-
