JUSTICE SOUMITRA SAIKIA ORDER 23.03.2026 Heard Mr. K Borah, learned counsel for the petitioner. 2. The petitioner is aggrieved by the impugned order dated 15.03.2026 whereby the petitioner stood transferred from Morigaon to Nagaon. The petitioner is working as Senior Inspector in the Office of the ARCS, Morigaon and by the impugned order, he has transferred to DRCS, Nagaon. The grievance of the petitioner is that he suffers from ill health and therefore he is not in a position to comply with the order. Being aggrieved, the petitioner is before this Court. 3. On the last date, i.e. 18.03.2026, the respondents were permitted opportunity to complete their instructions. 4. Today when the matter is fixed, Mr. G Bordoloi, learned Standing Counsel, Co-operation Department submits that the transfer order is not specially against the writ petitioner but the transfer order passed against several officers where the petitioner is one of the officers whose name is appeared at Sl. No. 8 of the order, he sought to be transferred. The transfer order was issued in terms of the guidelines/ Standing Order of the Election Commission that persons who Page No.# 3/3 have completed the tenure in their places of posting and persons who are posted in their home districts and also persons who are in the same district as in the last election are required to be transferred out. Accordingly, the petitioner being posted in his home district at Morigaon, was transferred to Nagaon. There is no infirmity in the order and therefore the same does not call for interference. 5. The only grievance of the writ petitioner is that he suffers from ill health. 6. The guidelines which are enclosed to the writ petition also reflects that the exceptions to the guidelines are provided in Clause-7 of the Election Commission Notification dated 09.02.2026. The petitioner is not covered in any of these categories. 7. Under such circumstances, since the transfer is being effected only on the guidelines or Standing Orders of the Election Commission, this Court does not find any infirmity in the order, accordingly, no interference is called for. The writ petition being devoid of merits and the same stands dismissed. No order as to costs. JUDGE Comparing Assistant
