1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.72/2026 registered at Police Station Gurur, District Balod (C.G.) for the offence under Section 34 (2) of the CG Excise Act. 2. 2 from the informant that on the date of the incident an unknown person was carrying illegal country made liquor in his Scooty (two wheeler) for sale, the concerned Police has conducted a raid and seized 6.480 bulk liters of country made liquor. Thereafter the offence was registered against the present applicant. Hence the bail application. 3. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the crime. The police has not seized any article from possession of the present applicant, as the recovery has been effected from the open place. The police did not investigate the matter properly. The applicant is in jail since 7.4.2026. Therefore, the applicant may be released on bail. 4. On the other hand, learned counsel appearing for the State/non- applicant would oppose the bail application and submits that the applicant has 3 criminal antecedents registered against him under the Excise Act. Therefore, the present bail application may be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and the fact that the applicant was carrying country made liquor illegally, for which no valid document was produced by the applicant before the concerned police and that the applicant has 3
3 criminal antecedents registered against him under the Excise Act, this Court is not inclined to release the applicant on bail.
7. Accordingly, the bail application of applicant – Bharat Lal Gangber involved in Crime No.72/2026, registered at Police Station Gurur, District Balod for the offence punishable under Section 34 (2) of the CG Excise Act, is rejected. -
