The applicant has preferred this application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of 2 Anticipatory Bail, as she is apprehending her arrest in connection with Crime No. 173/2026, registered at Police Station – Ramanujnagar, Surajpur (C.G.) for the alleged commission of offence punishable under Sections 318(4), 336(4), 338 and 340 of the Bhartiya Nyaya Sanhita, 2023. 2. The prosecution story, in brief, is a complaint was lodged by Dharmsay Lakda, Incharge Block Education Officer, Ramanujnagar, District- Surajpur, Chhattisgarh on the basis of the Letter No. Sat/G/Surajpur/78/2026/637 dated 08.06.2026 issued by Reference Manager, Directorate of Public Instructions to register FIR against the applicant. It was alleged that the applicant who is posted as Teacher (L.B.) at Government Primary School, Pathrapali, Development Block-Ramanujnagar, District Surajpur produced forged transfer order before Block Development Officer, Ramanujnagar, District- Surajpur and Principal, Government Primary School, Pathrapali, Development Block- Ramanujnagar, District- Surajpur and further requested to relieve her from the duty. The facts are such that a transfer order No. F-2-28/2025/20- Teen dated 08.10.2025 was issued by the State Government, School Education Department, Mantralaya, Mahanadi Bhawan, Nawa Raipur, Atal Nagar. In that transfer order, at Serial no. 07, the transfer of Shri Deepak Singh Thakur from Devpur, District- Dhamtari to Hatkeshwar (SAGES), Dhamtari was mentioned. However, it was alleged that the applicant fraudulently and dishonestly tampered with the said government transfer order by 3 replacing the name of Shri Deepak Singh Thakur with her own name and posting and presented the same before the Block Education Officer, Ramanujnagar and Principal, Government Primary School, Pathrapali, Development Block- Ramanujnagar, District- Surajpur, thereby falsely representing that she had been transferred from Pathrapali to Devnagar, and on the basis of this forged document, got herself relieved from her duties. When this matter came before knowledge of the concerned authorities, the Directorate of Public Instruction, Nava Raipur directed a criminal case to be registered against the applicant for committing the said criminal act. Based on the above allegations the present FIR was registered on 10.06.2026 against the applicant. 3. Mr. Manoj Paranjape, learned Senior Advocate appearing for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He submits that the present applicant is Teacher (L.B.) and she has been transferred to another place. It has been further submitted that the applicant has also been paid salary for 08 months and in an inquiry, it has been alleged that the applicant has tampered with the transfer order and vide order dated 08.06.2026, the applicant has been suspended from her duty. Learned counsel also submits that there was no formal departmental enquiry by the concerned department before proceeding against the applicant and no opportunity of hearing was given to the applicant and directly an FIR was registered against the applicant. He also submits that there is 4 nothing on record to suggest any mala fide intention on the part of the applicant. The prosecution has failed to produce any material indicating that applicant had mens rea and willfully tampered with transfer order to get a wrongful gain. Learned counsel also submits that the present applicant has no criminal antecedents, therefore, he prays for grant of anticipatory bail to the present applicant. 4. On the other hand, learned State counsel opposes the anticipatory bail application of the present applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, submission of learned counsel for the parties, material available on record, considering the nature of allegation levelled against the applicant, further that the applicant has been paid salary for 08 months after the transfer order and also considering the fact that the investigation and trial are likely to take some time, without commenting anything on the merits of the case, I am inclined to grant anticipatory bail to the Applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Savita Sahu, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, she shall be released on bail on the following conditions:- 5 (a) she shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such fact to the Court. (b) she shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) she shall appear before the trial Court on each and every date given to her by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
