This petition has been preferred by petitioners under Article 226 of the Constitution of India seeking following reliefs:- “10.1 That, this Hon’ble Court be pleased to call the entire records pertaining to the case of the petitioner. 10.2 That, this Hon’ble Court be pleased to issue an appropriate writ, thereby directing the respondent authority to forthwith DEEPTI JHA Digitally signed by DEEPTI JHA 2 released the total amount of admitted bill of Rs.9,97,485/- + Rs23,38,195/- total amount of Rs.33,35,680/- 10.3 That, this Hon’ble Court be pleased to issue an appropriate writ, thereby directing the respondent authority to pay interest @ 12% p.a. from the date of entitlement to its actual payment on the pending admitted bill amount. 10.4 Any other relief/order which may be deemed fit and just in facts and circumstances of this case including award of cost of the petition may be given.” 3. Learned counsel for the petitioner submits that respondent authorities have not paid the amount of Rs.33,35,680/- to the petitioner for the supply, which he has made as per the work order issued to him by the respondent authorities. Learned counsel for the petitioner further submits that petitioner has already supplied the material, as per the direction made in the work order, he is required to be paid the aforesaid amount in accordance with law. There is no dispute regarding non supply of the material, as such the petitioner is claiming the aforesaid reliefs. 4. Learned State counsel while filing reply submits that only Rs.9,40,470/- is the undisputed amount. So far as the rest of the amount is concerned and it is still disputed and upon verification made by the authorities only a sum Rs.9,40,470/- is found to be undisputed and so far as this much amount is concerned, the respondents are ready and willing to disburse the said amount, if the petitioner approaches before the concerned authorities. 5. I have learned counsel for the parties and perused the material available on record carefully. 6. Vide para 3 of the reply of the State, it is specifically stated that upon due verification in respect of forest product and chemical fertilizer to Shankargarh Nursery, it was found that out of Rs.33,35,680/- products and articles worth Rs.9,40,470/- has been received and so far as rest of the amount is 3 concerned. Upon verification rest of the amount is not found to be supplied by the petitioner. 7. Considering the aforesaid aspect of the matter, so far as undisputed amount of Rs.9,40,470/- is concerned, the respondent authorities are directed to pay the aforesaid amount and disburse the same in favour of the petitioner within a period of 45 days from today. 8. It is made clear that this Court has not passed any order in respect of remaining amount except Rs.9,40,470/-, which according to the respondent authorities is undisputed. So far as the remaining part is concerned, petitioner is at liberty to avail the alternative remedy under the law. 9. Interlocutory application(s), pending if any, also stands disposed of.
