JUSTICE E.S.INDIRESH ORAL ORDER 1. Heard learned counsel appearing for the parties. 2. In this Writ Petition, petitioner is assailing the endorsement dated 15.10.2025 (Annexure-E) passed by respondent No.3, inter alia, sought for a direction to the respondent - authority to consider Form-53 filed by the petitioner as noted in Annexure-B and Annexure-A dated 28.04.1999. - 3 - HC-KAR NC: 2026:KHC:31305 WP No. 1213 of 2026 3. Having heard the learned counsel appearing for the parties, on careful consideration of the impugned endorsement dated 15.10.2025 (Annexure-E), would indicate that it is not in dispute that the petitioner herein has filed Form 53 seeking right over the property in question as an unauthorised occupant. However, it is stated in the endorsement that the same has not been uploaded in the Bagarhukum App. In this regard, in identical circumstances, this Court in the case of SMT. MALLAMMA AND ANOTHER Vs. THE STATE OF KARNATAKA AND OTHERS in W.P.No.38363/2025 disposed of on 29.01.2026, at para 5 of the Order, observed as follows: 5. Having regard to the contentions raised in the writ petition and submissions of the learned Counsel for the petitioners, this Court is of the considered opinion that when once the application in Form No.53 filed seeking regularization of unauthorized occupation is admitted, the 2nd respondent-Tahsildar was duty bound to place the application filed by the petitioner before the ‘Committee for Regularization of Unauthorized Occupation’ and the Committee was also duty bound to consider the application and pass necessary orders. Therefore, the Tahsildar cannot issue such an endorsement rejecting the application, on a technical ground." - 4 - HC-KAR NC: 2026:KHC:31305 WP No. 1213 of 2026 4. Following the declaration made by this Court as referred to above, the present Writ Petition is disposed of with a specific direction to respondent No.3 to place the application in Form- 53 filed by the petitioner before the Committee for regularisation of unauthorised occupation within a period of two months from the date from which the Committee would be constituted if not already constituted. Once the Committee is constituted, such Committee is required to consider Form-53 and pass necessary order in accordance with law, as expeditiously as possible, at any rate, within three months thereafter. 5.
