1. By the present writ petition, the petitioner is seeking a direction towards the respondent No.2/Collector, Korba to consider and decide the representations submitted by the petitioner seeking revocation of the suspension order and reinstatement in service.

2 was appointed to the post of Assistant Grade-III in the respondent department on 21/01/2014. However, on 21/03/2022, an FIR was registered against the petitioner under Section 509(B) of the Indian Penal Code and Section 67(A) of the Information Technology Act, 2000 and was consequently placed the petitioner under suspension. Pursuant to said FIR, a criminal case was registered against the petitioner. Learned counsel further submits that after conclusion of the trial, the learned Judicial Magistrate First Class, District Korba, vide its
judgment dated 18/05/2026 passed in Criminal Case No.890/2022, acquitted the petitioner of all the charges levelled against him. Learned counsel further submits that, following his acquittal, the petitioner submitted several representations for reinstatement in service with all consequential service benefits. However, despite the lapse of considerable time, no decision has been taken on the said representations and because of the inaction on the part of the respondent authorities, the petitioner is facing hefty financial difficulties.

Learned counsel for the State submits that the pending representations filed by the petitioner will be considered in accordance with law within a period of 40 days and necessary
order will be passed thereafter.
4. I have heard learned counsel for the parties, perused the pleadings and documents.

Having considered the submissions advanced by learned counsel for the parties and the facts and circumstances of the case, the present writ petition is disposed of with a direction to the respondent authorities to consider the petitioner's representations (Annexure P-4 colly.) within a period of 40 days and to pass a necessary order in accordance with law, from the date of receipt of copy of this order.
6. It is made clear that this Court has not expressed any opinion on merits of this case, it is for the competent authority to consider the case of petitioner on its own merits. SD/-
