Som, learned counsel for the accused applicants and Mr. K. K. Parasar, learned Additional Public Prosecutor for the State. 2. This is an application under Section 483 of the BNSS, 2023 for granting bail to the accused applicants, who were in custody since 05.02.2026 in connection with North Lakhimpur P.S. Case No. 435/2025 under Section 11(1) (d) of the Prevention of Cruelty to Animals Act. 3. An FIR was lodged on 09.12.2025 by one Priyamjyoti Phukan, an animal lover, stating that there had been a large-scale disappearance of stray dogs from various localities of North Lakhimpur town. Being an animal lover, he made inquiries into the matter and found that several dogs had gone missing in recent weeks. In view of the above, he filed an FIR before the North Lakhimpur Police Station regarding the missing dogs. 4. Upon receipt of the FIR, the police registered Lakhimpur P.S. Case No. 435/2025 under the aforementioned section. During the investigation, the police recovered three (3) stray dogs from the possession of the accused applicants. The police forwarded the accused applicants to the learned Chief Judicial Magistrate, North Lakhimpur, Assam, on 06.02.2026, and since then, the accused applicants have been in judicial custody. 5. Learned counsel for the accused applicants submits that the accused Page No.# 3/3 applicants are in no way connected to the aforesaid allegations of missing dogs. Rather, they kept the dogs out of affection and were not involved in selling or consuming them. 6. Having heard the submission made by the counsel for the accused applicants and taking into account the materials brought before this Court, this Court is of the view that the accused applicants should be granted bail at this stage. Therefore, it is directed that the accused applicants shall be released on bail forthwith upon furnishing a bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, North Lakhimpur, Assam, subject to the following conditions: i. that the accused applicants shall cooperate with the investigation; ii. that the accused applicant shall appear before the investigating authority as and when required; iii. that the accused applicant shall not directly or indirectly make any inducement, threat or promise to any person, who may be acquainted with the facts of the case, so as to dissuade such person from disposing such facts before the investigating authority against the accused applicant; 11. In view of the aforesaid directions, the instant bail application is, accordingly, disposed of as allowed. JUDGE Comparing Assistant
