Petitioner’s candidature for appointment to the post of Nursing Officer (Female) was rejected by the Selecting Body on the ground that she did not have a valid registration with Uttarakhand Nursing and Midwives Council till the last date of submission of application. 6. Perusal of the record reveals that petitioner was earlier registered as Nurse and also as Midwife with Maharashtra Nursing Council, Mumbai. The registration certificates issued by Maharashtra Nursing Council are on record as Annexure 1 to the writ petition, which were issued on 23.10.2015. 7. Learned counsel for the petitioner submits that petitioner applied for transfer of registration from Mumbai to Uttarakhand and she had also submitted the requisite transfer fee with Uttarakhand Nursing and Midwives 2026:UHC:2100 Council on 14.09.2016. However, her registration was transferred to Uttarakhand in the month of July, 2024 and registration certificate was issued in her favour by Uttarakhand Nursing and Midwives Council on 06.07.2024. He submits that petitioner is not at fault in any manner, as she had requested for transfer of her registration from Mumbai to Uttarakhand in 2016, while the advertisement for the post of Nursing Officer (Female) was issued on 11.03.2024. 8. Learned counsel for the petitioner relies upon a judgment rendered by this Court in WPSS No. 2331 of 2024, where a similar issue was decided. He submits that since the issues involved in this writ petition are identical to the one, decided in WPSS No. 2331 of 2024, therefore, this writ petition deserves to be decided in terms of that judgment. 9. Mr. Ramji Srivastava, learned counsel appearing for respondent no. 5 concedes that the identical issue was decided in the said judgment. 10. In view of consensus between the parties, the writ petition is decided in terms of the judgment dated 06.11.2025 rendered in WPSS No. 2331 of 2024 & other connected matters.
