A formal agreement bearing No. 71 of 2019-20 1Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:41484 (Annexure P-2), was executed between the parties. The work was actually completed on 31.08.2024 and the requisite notice dated 20.01.2025 (Annexure P-3), was sent on 20.01.2025, invoking Clause 25 of the GCC for appointment of the Sole Arbitrator and claiming various amounts including withholding the final bill, price escalation payable and idling of manpower and machinery etc. 3. In the reply, it was stated that there was a delay of 47 months in completion of the work and the same was finished on 31.08.2024. However, contrary stand as such, was taken that the appointment of the Arbitrator was premature and untenable. 4. It has been further mentioned in the reply that various letters were issued during the period from 03.07.2020 to 04.02.2022, urging the Contractor to speed up the work and admission has been made that time was extended for price escalation for the period with effect from 01.09.2020 to 31.03.2024 vide letter dated 17.09.2024. 5.
