Order on Board 06/07/2026
1. The applicant has preferred this first application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail apprehending his arrest in connection with Crime No. 275/2026, registered at Police Station Civil Lines, Rampur, District Korba (C.G.), for the offences punishable under Sections 115(2), 296, 351(3), 324(4), ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2026.07.07 13:06:04 +0530
2 109(1), 333 and 191(3) of the Bharatiya Nyaya Sanhita, 2023.
2. The prosecution case, in brief, is that on account of previous enmity, the applicant along with co-accused persons abused the complainant in filthy language, assaulted him with fists and a spade causing injuries on his head, extended threats to kill him and his family members, and also caused damage to the doors, windows of the complainant’s house and his motorcycle.
3.
Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that no material has been collected by the investigating agency to attract the offences under Sections 109(1) and 333 of the Bharatiya Nyaya Sanhita. It is also submitted that the applicant is ready and willing to cooperate in the investigation and shall appear before the Investigating Officer as and when required. It is further submitted that in the event of arrest, the applicant would suffer irreparable loss and injury to his reputation. It is lastly contended that the applicant is a permanent resident of the address mentioned in the cause title and there is no likelihood of his absconding or tampering with the prosecution evidence, hence he deserves protection of anticipatory bail. 4. Per contra, learned State counsel opposes the application and submits that the allegations against the applicant are grave in nature. It is contended that the case diary reflects the active involvement of the applicant in the alleged incident and, therefore, the applicant is not entitled to the benefit of anticipatory bail. 3
5. I have heard learned counsel for the parties and perused the case diary. 6. Upon perusal of the case diary, it appears that Crime No. 275/2026 has been registered against the present applicant along with other co-accused persons. The specific allegation against the applicant is that on 31.03.2026, due to previous enmity, he along with co-accused abused the complainant in filthy language, assaulted him with fists and kicks, inflicted injury on his head by means of a spade, and extended threats to kill him and his family members. It is further alleged that the applicant and co-accused persons also assaulted the complainant’s wife and daughter and thereafter caused damage to the doors, windows of the complainant’s house and his motorcycle. 7. Considering the nature and gravity of allegations, the specific overt acts attributed to the applicant, and the manner in which the offence is alleged to have been committed, this Court is not inclined to extend the benefit of anticipatory bail to the applicant, without expressing any opinion on the merits of the case. 8. Accordingly, the application is devoid of merit and is hereby rejected. 9.
This Court hopes and trust that the trial Court shall make all sincere endeavours to conclude the trial as expeditiously as possible without being influenced by any observations made herein. SD/-
