Heard Mr. Dheerendra Pandey, learned counsel for the petitioners. Also heard Mr. Sumit Singh, learned Deputy Advocate General for respondent / State. 2. The petitioners have filed this petition praying for following relief:- “(i) It is therefore prayed that this Hon'ble court may be pleased to allow the application by making an order to Quash the Charge Sheet No. 365/2025 dated 17.11.2025 and cognizance order of the impugned chargesheet dated 26.12.2025 and all consequential proceedings in FIR crime no. 90/2025 dated 21.02.2025, pending before the Judicial Magistrate First Class, Balodabazar District Balodabazar-Bhatapara (C.G.), registered as Criminal Case No. 5453/2025 offence u/s 318(4), 3(5) OF BNS ACT. 2023. (ii) The Hon'ble Court may kindly be pleased to call for the entire records pertaining to the impugned Criminal Case No. 5453/2025 offence u/s 318(4), 3(5) OF BNS ACT. 2023, P.S. Lawan District Balodabazar-Bhatapara (C.G), titled as 'State of Chhattisgarh Vs. Kainhaiya Lal Sahu & and others' currently pending before the Court of Judicial Magistrate first class, Balodabazar District Balodabazara-Bhatapa (C.G). (iii) Any other relief which this Hon'ble Court deems 3 fit in the facts and circumstances of the case along with cost of the petition be awarded in favour of the applicants.” 3. From perusal of the present petition, it transpire that the charges have already been framed against the petitioners, however, the same has not been challenged in the present petition. 4. In view of the same, learned counsel for the petitioner prays to withdraw the present petition with liberty to file afresh. 5. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh. 6. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner after obtaining the photocopy of the same, subject to deposit of the fine amount.
