KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.07.07 18:46:44 +0530 2 2. Case of the prosecution is that on 10.1.2025, when the applicant along with his friends Rahu Haldar and Shubham Sarkar were passing near medical College Chowk, at that time, Vineet Boss, Shivam Mishra, Ayush Jaiswal and his companions came together in a Car and bike and started abusing them in filthy language. They attacked them with iron rods and sharp weapons, due to which one Harshit Chakraborty received injuries on his head and his other friends were also got injured, and the said persons also threatened to kill them. 3. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated. The applicant has not committed any offence and the police did not make proper enquiry about the incident and the present applicant has been made accused in this offence on the basis of false and baseless allegation, and the police has not seized any article from possession of the applicant. Co-accused has already been released on bail by this Court vide order dated 20.3.2025 passed in MCRC No.2223/2025. Therefore, the applicant may be released on bail. 4. On the other hand, learned counsel appearing for the State/non- applicant would oppose the bail application. However, he submits that the applicant had assaulted on the head of the injured with iron rod, as a result of which the injured received severe injuries on his head. He submits that the applicant has 15 criminal antecedents registered against him, out of which 6 criminal cases 3 are pending, and the co-accused who has been released on bail by this Court had only 3 criminal antecedents. Therefore, the bail application may be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the submissions of learned counsel for the parties, particularly considering the fact that the applicant has caused serious injuries on the head of the injured, he has 15 criminal antecedents, out of which 6 criminal cases are pending against him and the co-accused who has been released on bail by this Court had only 3 criminal antecedents, this Court is not inclined to release the applicant on bail. 7. Accordingly, the bail application of Applicant – Aaditya Yadav @ Lalla involved in Crime No.41/2025, registered at Police Station Gandhinagar, District Surguja for offence punishable under Section 296, 351 (3), 115 (2), 109, 190 & 191 (2) of the Bharatiya Nyaya Sanhita, 2023 is rejected. - Sd/- (Ramesh Sinha) Chief Justice Barve
