This first anticipatory bail application under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.378/2025 registered at Police Station – Kasdol, District Balodabazar-Bhatapara (C.G.) for the offence punishable under KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.07.07 11:04:35 +0530 2 Sections 318 (4), 316 (5), 318 (3), 3(5) & 111 of Bharatiya Nyaya Sanhita (for short ‘BNS’). 2. The prosecution story, in brief, is that on 25.8.2023 complainant Gopal Prasad Dewangan went to the house of the applicant to meet Ramnarayan Sahu and his son Gulshan Sahu for the work of steel railing, on which he was offered to invest in share trading to double the amount invest. On such assurance, the applicant gave Rs.5,25,000/- and gave a sum of Rs.19,43,000/- to the complainant in cash and through IMPS. It is alleged that total sum of Rs.40,82,000/- was invested in two years. When the complainant demanded his money back, the applicant did not return the same and thereby cheated the complainant. Hence, the bail application. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He further submits that only on the basis of memorandum of statement of the co-accused, the applicant has been roped in the offence. It is stated that the applicant was also involved in Crime No.659/2024 registered at PS Mandir Hasaud, District Raipur for offence under Section 420 of the IPC in which he was granted regular bail along with co-accused Manohar Lal Sahu vide order dated 2.1.2025 passed in MCRC No.8987/2024. It is also submitted that the applicant was also involved in Crime Nos.430/2025, 470/2025 & 433/2025 registered at PS Kasdol, District Baloda Bazar-Bhatapara, in which he has already been 3 granted anticipatory bail by this Court vide orders passed in MCRCA Nos.757/2026, 741/2026 & 690/2026. Therefore, the applicant may be released on anticipatory bail. 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail to the applicant. 5. I have heard learned counsel for the parties and perused all of the documents taken on record. 6. Considering the facts and circumstances of the case, and the fact that the applicant has already been released on anticipatory bail in different crime numbers registered against him vide orders passed in MCRCA Nos.757/2026, 741/2026 & 690/2026, this Court is inclined to extend the benefit of anticipatory bail to the applicant in the present case also. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Bhuneshwar Sahu, on executing a personal bond with one surety in the like sum to the satisfaction of the Arresting Officer, he shall be released on bail on the following conditions:- (a) He should not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) He should not act in any manner which will be prejudicial to fair and expeditious trial. (c) he should appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The Applicant and the sureties shall submit a copy 4 of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
