This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.571/2023 registered at Police Station Kota, District Bilaspur (C.G.) for the offence under Section 376 (2)(n) of the IPC. Case of the prosecution is that on 4.7.2023, the victim has lodged a written report with the concerned Police Station stating that on 11.6.2023 the applicant has committed sexual intercourse with her on the pretext of marriage and they lived together for some time and thereafter the applicant ran away and did not return. Thereafter, the FIR was registered. Hence the present bail application. 3. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated. The applicant and the victim are major and thus consenting party. As per the medical report, there is no external or internal injury found on the body of the victim. Therefore, the applicant may be released on bail. 4. On the other hand, learned counsel appearing for the State/non- applicant would oppose the bail application. However, she submits that the applicant was allegedly absconding and the applicant was arrested after issuance of warrant of arrest. If the bail application is allowed, there is every likelihood that the applicant may again abscond. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the submissions of learned counsel for the parties, particularly considering the fact that the applicant was absconding soon after the incident and was arrested in pursuance of the 3 warrant of arrest issued on 18.3.2026, this Court is not inclined to release the applicant on bail. 7. Accordingly, the bail application of Applicant – Rambali Patel involved in Crime No.571/2023, registered at Police Station Kota, District Bilaspur for offence punishable under Section 376 (2)(n) of the IPC is rejected. - Sd/- (Ramesh Sinha) Chief Justice Barve
