Accused nos.1 to 4 in Crime No.137 of 2026 registered by Parappana Agrahara Police Station, Bengaluru City for offences punishable under Sections 115(2), 118(1), 351(2), 351(3) 74 R/w Section 3(5) of BNS, 2023 are before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.137 of 2026 was registered by Parappana Agrahara Police Station, Bengaluru City, for the aforesaid offences against the petitioners herein, based on the first information dated 24.03.2026 received from Smt. Bhavani - 3 - HC-KAR NC: 2026:KHC:32484 CRL.P No. 7070 of 2026 B. K ., who is one of the injured victim in the present case. Apprehending arrest in the said case, petitioners had filed Crl.Misc.No.3362 of 2026 before the jurisdictional Sessions Court, which was rejected on 17.04.2026. Therefore, they are before this Court. 4. Learned counsel for the petitioners submits that there is a monetary dispute between the two parties and a false complaint has been lodged for extraneous reasons. He submits that, there is a delay in approaching the police and in the incident in question only minor injuries were suffered by the victim. He also submits that, there are cases and counter cases filed between the two parties and therefore a false case has been registered against the accused. 5. Per contra, learned Additional State Public Prosecutor and learned counsel appearing for the defacto complainant have opposed the petition. 6. Learned counsel for the defacto complainant has produced medical records of injured victim Dhananjay and - 4 - HC-KAR NC: 2026:KHC:32484 CRL.P No. 7070 of 2026 submits that, Dhananjay had suffered grievous injuries as a result of the assault made by accused no.1 with a wooden club. Dhananjaya has suffered multiple fractures and he was admitted in the hospital for his treatment. Accordingly, he prays to dismiss the petition. 7. From a reading of the first information, it appears that there is some dispute between the two parties with regard to certain financial transactions between them. On the alleged date of incident, accused nos.1 to 4 came to the house of the first informant and after abusing her, tried to outrage her modesty. When her husband Dhananjay tried to interfere, accused persons allegedly assaulted him and caused grievous injuries. Thereafter, they had left the place after criminally intimidating the victims. 8. The allegation of assaulting injured victim Dhananjay with a wooden club is found in the FIR as against accused no. 1 - Sridhara. It appears that, accused no.1 - Sridhara is a person with criminal antecedents. Insofar as the other accused persons are concerned the only allegation as - 5 - HC-KAR NC: 2026:KHC:32484 CRL.P No. 7070 of 2026 against them is that they had assaulted the victims with hands. Dhananjay has suffered grievous injuries as could be seen from his medical report which is made available to this court by the learned advocate for the defacto complainant. Under the circumstances, I am of the opinion that the prayer made by accused no.1 for grant of anticipatory bail needs to be rejected and insofar as the other accused are concerned, their prayer for grant of anticipatory bail can be entertained. 9. Accordingly, the following: ORDER The Criminal Petition is partly allowed. Criminal Petition is allowed insofar as it relates to petitioner nos.2 to 4 / accused nos.2 to 4 are concerned. Insofar as it relates to petitioner no.1 / accused no.1 is concerned, criminal petition is dismissed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner nos.2 to 4 / accused nos.2 to 4 in the event of their arrest in Crime No.137 of 2026 registered by Parappana Agrahara Police Station, - 6 - HC-KAR NC: 2026:KHC:32484 CRL.P No. 7070 of 2026 Bengaluru City for offences punishable under Sections 115(2), 118(1), 351(2), 351(3) 74 R/w Section 3(5) of BNS, 2023 subject to the following conditions:- 1. The petitioners / accused nos.2 to 4 shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each, with two sureties for the likesum to the satisfaction of the investigating officer/jurisdictional Court. 2. The petitioners / accused nos.2 to 4 shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3.
