The petitioner is apprehending his arrest in connection with Latehar P.S. Case No.47 of 2026, for the alleged offences registered under Sections 316(2), 316(5), 318(4) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned C.J.M., Latehar. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and the petitioner has not misappropriated the government money. He further submits that false allegations are made of not sending paddy to the rice millers. He then submits that earlier certificate case was instituted for the same occurrence. On these grounds, he submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposed the prayer and submits that allegations are there of not sending 722.58 2026:JHHC:26525 --2-- A.B.A. No. 4112 of 2026 quintals of rice to the rice millers and misappropriation of Rs.14,81,289/- and the said amount was withdrawn from the treasury. On these grounds, he submits that anticipatory bail may kindly be rejected. 5. Considering that there is direct allegation against the petitioner of misappropriating paddy and even withdrawal of Rs.14,81,289/- from the treasury and that has come in page No.16 of the case diary and in paragraph No.9 of the case diary there is direct allegation against the petitioner of embezzlement of government money, I am not inclined to grant privilege of anticipatory bail to the petitioner, hence, the prayer for anticipatory bail of the petitioner is hereby rejected.
