JUSTICE RANJAN KUMAR JHA ORAL ORDER 2 14-07-2026 Heard learned counsel appearing on behalf of the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. 2. The petitioners are apprehending their arrest in connection with Tilauthu P.S. Case No. 71 of 2026 registered for the offences punishable under Sections 189(2), 126(2), 115(2), 109, 352, 351(2) of the BNS 2023. 3. The allegation against petitioners in the FIR is that, while the informant was returning towards his home, he was Patna High Court CR. MISC. No.43020 of 2026(2) dt.14-07-2026 2/3 surrounded by the seven accused persons named in the FIR, who allegedly assaulted him with lathi and danda, resulting in injury to his head. 4. Learned counsel for the petitioners submits that, prior to the institution of the present case, the petitioners had lodged a case against the informant, in the said background the present FIR has falsely been instituted. He further submits that, although the FIR alleges that all seven accused persons assaulted the informant but the injury report reveals that the injuries sustained by the informant are simple in nature. 5. Learned APP opposed the prayer of anticipatory bail vehemently. 6. Considering the rival submission, this Court finds that there is a dispute between the parties. The allegation in the FIR are limited to the extent that all the petitioners assaulted the informant, and the injuries sustained are simple in nature, accordingly, all above named petitioners, in the event of their arrest or surrender before the learned trial Court, within a period of four weeks of the order, is directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in Patna High Court CR.
