This transfer petition is filed by the wife for transfer of M.C.No.58/2025 filed by the husband for restitution of conjugal rights before the Senior Civil Judge, Hosadurga. 3. Petitioner is residing with her parents and also two minor children aged 6 and 4 years respectively. Her main contention is that respondent is having illicit relation with a person namely, Bhagya but he has filed this petition only to trouble her. She filed Criminal Misc.No.967/2025 for maintenance and it is still pending before the Principal Civil Judge and JMFC, Arasikere. The distance between Hosadurga and Arasikere is 80 kilometres. It is stated that respondent is a Cab owner and he is even posting his photographs with Bhagya in the social media. 4. Learned counsel for the respondent stated that respondent is residing in Hosadurga along with his aged - 3 - HC-KAR NC: 2026:KHC:29572 CP No. 86 of 2026 parents and there is threat to his life. He also gave complaint and FIR copy is not with him. 5. Considering the arguments of learned counsel for both the parties, though the respondent filed restitution of conjugal rights, in view of the allegations made by the petitioner against him and also the distance between both the places and the fact that she is having two minor children and has no source of income, this Court finds that it is just and reasonable to transfer M.C.No.58/2025 from the Senior Civil Judge and JMFC, Hosadurga to the Principal Senior Civil Judge and JMFC, Arasikere.
