IN THE HIGH COURT OF HIMACHAL PRADESH AT SHIMLA CWP No. 5353 of 2026 Decided on : 28.09.2026 Balbir Rana Petitioner Versus State of Himachal Pradesh and others Respondents Coram Hon’ble Mr. Justice Ajay Mohan Goel, Judge Hon’ble Mr. Justice Yogesh Jaswal, Judge Whether approved for reporting?1 For the petitioner : Mr. Anshul Attri, Advocate. For the respondents : Mr. Sushant Keparate, Additional Advocate General and Mr. Rajat Chauhan, Assistant Advocate General, for respondents No.1,2 & 4. Mr. Surender Sharma, Sr. Advocate with Mr. Neeraj Sharma, Advocate, for respondent No.3 Ajay Mohan Goel, Judge (Oral) By way of the present writ petition, the petitioner has inter alia prayed for the following reliefs:- “(i) That the impugned Notification dated 7th April, 2026 (Annexure P-8), whereby the rotation of election reservation roster has again been 1 Whether reporters of the local papers may be allowed to see the judgment? 2 reserved for women in Ward No.2 (Danaghaton), Zila Parishad, Sirmaur, District Sirmaur, HP may kindly be quashed and set aside qua Ward No.2, (Danaghaton), Zila Parishad, Sirmaur, District Sirmaur, HP (ii) That the respondents may further be directed to re-draw the reservation roster strictly in accordance with the provisions of the Himachal Pradesh Panchayati Raj Act, 1994, and Constitutional mandate of fair and reasonable rotation, by granting due representation to male candidates belonging to General /SC/ OBC/ category. 2. We have carefully gone through the pleadings, that is to say, the contents of the writ petition and we do not find any averment made therein to the effect that though, he intended to contest the election, however, on account of the reservation of the Ward in issue in favour of the women, the petitioner, has been precluded from contesting the election. 3. That being the case, obviously, in our considered view the petitioner does not has any locus to file and maintain the present writ petition, which inter alia assails the act of the respondents of reserving Ward No.2. (Danaghaton,) Zila Parishad, Sirmaur, District Sirmaur, H.P for woman candidate. 4. Accordingly, in the light of the above observations, this writ petition is dismissed as not maintainable with the observation 3 that the issue, which has been raised herein by the petitioner is otherwise kept open.
