(2) Petitioner’s mother, who was employed as Workshop Attendant in Government ITI at Srinagar, Pauri Garhwal, died while in service on 2.4.2021. Petitioner’s father requested that petitioner be given compassionate appointment in place of her mother, as petitioner’s brother suffers from psychiatric disorder and is mentally disabled to the extent of 70 per cent. Petitioner’s claim for compassionate appointment has been turned down on the ground that her name does not figure in the service record of the deceased employee late Rajni Devi. (3) Learned Counsel for the petitioner submits that even though petitioner is married daughter of late Rajni Devi, however, in view of judgment rendered by Full Bench of this Court, married daughter cannot be denied compassionate appointment. He submits that applicable rules have also been amended so as to include married daughter within the definition of ‘family member’. He further submits that petitioner’s name has now been included in the survivorship certificate, issued by Sub Divisional Magistrate, therefore the reason assigned for not considering petitioner’s claim for compassionate appointment does not exist anymore. (4) Learned State Counsel submits that petitioner can make fresh application enclosing all documents, including survivorship certificate. (5) Writ petition is, accordingly, 2026:UHC:1471 disposed of with liberty to petitioner to make fresh application enclosing all supporting documents. If she makes such application within two weeks from today, the competent authority shall revisit the matter and pass appropriate order, as per law, within ten weeks thereafter.
