The instant bail application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 on behalf of accused-petitioner in connection with FIR No. 193/2025 registered at Police Station Kishangarh Bas, District Khairthal-Tijara for offence under Sections 103(1), 238(a) of BNS 2023. 2. Learned counsel appearing for the petitioner submits that on the basis of the investigation report and evidence collected during investigation, the Court below has framed charge against the accused-petitioner for offences punishable under Section 239, 249A, 238/3(5) and 58A of BNS 2023. Counsel further submits that all other offences for which the charges have been framed are [2026:RJ-JP:16475] (2 of 3) [CRLMB-15778/2025] bailable offences except Section 58A of the BNS 2023. Counsel also submits that as per the conclusion of the investigation wherein the Police has concluded that the petitioner is found to be involved in disposing the dead body whereas the Section 58A of BNS 2023 is for an act of a person facilitating the other co- accused in commission of offence punishable with life imprisonment or death. Counsel further submits that there is no evidence collected by the investigating agency as regards any act of the petitioner facilitating the other co-accused in committing the murder of the deceased (Manoj). Learned counsel also submits that accused-petitioner is in custody since 21.07.2025. 3. Learned Public Prosecutor and learned counsel for the complainant opposed the bail application. 4. Learned counsel for the complainant submits that there is ample evidence on record as regards the act of the petitioner facilitating the other co-accused in disposing of the dead body of the deceased (Manoj). 5. Having regard to the submission made by the counsel for the petitioner, this Court at this stage without commenting anything on the issue whether the charge for offence under Section 58A BNS 2023 is made out or not and also without expressing any opinion on the merits or demerits of the case, deems just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the present bail application is allowed and it is directed that the accused-petitioner shall be released on bail provided that he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lax Only) together with two sureties [2026:RJ-JP:16475] (3 of 3) [CRLMB-15778/2025] in the sum of Rs.50,000/-(Rupees Fifty Thousand Only) each to the satisfaction of the learned Trial Court with the stipulation that he shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
