It appears that the de facto complainant and the accused persons are closely related to each other. On the basis of a complaint lodged by the de facto complainant, Airport Police Station Case No. 187 of 2013 dated July 1, 2013 was registered. Upon completion of the investigation, the police submitted a charge-sheet under Sections 419, 420, 467, 468, 469, 471 and 120B of the Indian Penal Code, 1860. Aggrieved by the initiation and continuation of the said proceedings, the petitioners have preferred the present revisional application seeking quashing thereof. It appears from the records that the disputes between the parties have since been amicably resolved. In this regard, the parties have jointly filed an application recording the terms of settlement and compromise, being CRAN 1 of 2026. Upon consideration of the materials on record, this Court is satisfied that the dispute giving rise to the present proceedings is
2 essentially private and personal in nature and that the parties have voluntarily entered into a lawful and genuine compromise. In such circumstances, the continuation of the criminal proceedings would serve no useful purpose and would amount to an abuse of the process of Court. Having regard to the principles enunciated by the Hon'ble Supreme Court in the case reported at (2024) 10 SCC 384 (K. Bharthi Devi v. State of Telangana) and (2008) 16 SCC 1 (Manoj Sharma v. State), this Court is inclined to exercise its inherent jurisdiction in order to secure the ends of justice and prevent abuse of the process of law. Accordingly, G.R. Case No. 2988 of 2013 arising out of Airport Police Station Case No. 187 of 2013 dated July 1, 2013 under Sections 419, 420, 467, 468, 469, 471 and 120B of the Indian Penal Code, 1860, presently pending before the Court of the learned 1st Judicial Magistrate at Barrackpore, stands quashed in terms of the compromise recorded in CRAN 1 of 2026. Consequently, CRR 1854 of 2026, along with CRAN 1 of 2026, stands disposed of.
