JUSTICE D K SINGH) The present intra court appeal has been filed impugning the judgment and order dated 26.09.2023 passed by the learned Single Judge in W.P.No.58116/2018. The appellant appears to be an incorrigible employee in committing the misconduct time and again. The records disclose that the appellant has been guilty of misconduct of similar nature on 14 occasions earlier for which he was punished with major penalty of dismissal from service by the authority vide order dated 30.03.2002. The appellate authority rejected the appeal vide order dated 16.04.2003. However, the Reviewing Authority - 3 - HC-KAR NC: 2026:KHC:30323-DB WA No. 1342 of 2024 modified the order of dismissal by directing his reinstatement as fresh appointee with forfeiture of past services rendered by him. 2. The appellant did not raise any objection to the order passed by the Reviewing Authority dated 14.10.2003 whereby the punishment order of dismissal was modified for reinstatement of the appellant as a fresher. The appellant raised the industrial dispute only in the year 2015, after delay of 7 long years from the date of the order passed by the Reviewing Authority. 3. The Industrial Tribunal vide award dated 23.12.2017 modified the order passed by the Reviewing Authority and restored the appellant's past services. 4. The learned Single Judge having considered the misconduct of the appellant allowed the writ petition filed by the Karnataka State Road Transport Corporation vide impugned judgment and set aside the order passed by the Industrial Tribunal. The learned Single Judge has taken note of the past misconducts of appellant/petitioner as well as of inordinate and unexplained delay and laches in raising the dispute after 7 years. 5. We are of the view that the judgment of the learned Single Judge impugned in this appeal does not require interference. - 4 - HC-KAR NC: 2026:KHC:30323-DB WA No. 1342 of 2024 Accordingly, the writ appeal is dismissed.
