JUSTICE RAMESH CHAND MALVIYA ORAL ORDER 4 16-07-2026 Heard learned counsel for the petitioner, learned APP for the State, perused the case diary as well as postmortem report of the deceased. 2. The petitioner is in custody in a case registered for the offence punishable under Sections 80 and 3(5) of the BNS, 2023. 3. As per allegation in the FIR, the daughter of the informant has been killed by the FIR named accused persons. 4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that during course of investigation, the police implicated the petitioner only on the ground that he used the mobile of the deceased with his SIM for two days and on that Patna High Court CR. MISC. No.22220 of 2026(4) dt.16-07-2026 2/3 basis, the police apprehended the petitioner and got prepared his confessional statement to the effect that he confessed his guilt and such confession of the petitioner before the police is not admissible evidence in the eye of law. Petitioner is in custody since 09.06.2025. He next submits that similarly situated co- accused persons have already been granted bail by a Co- ordinate Bench of this Court passed in Cr. Misc. No.87518 of 2025. 5. Learned APP for the State has opposed the prayer for bail of the petitioner and submits that the petitioner has got one criminal antecedent as stated in para-3 of the petition. 6. On perusal of the first information report, case diary, postmortem report of the deceased and impugned order dated 21.02.2026, it appears that petitioner and other co-accused persons have committed the murder of husband of the informant by sharp object and he confessed his guilt. From perusal of para- 4, 6, 7, 16 and 17 of the case diary, it appears that the cause of death of the deceased as stated by the doctor is haemorrhage shock caused by sharp pointed hard object, like, knife stab injury and charge-sheet has already been submitted against the petitioner and several witnesses have also supported the case of the prosecution, so I am not inclined to grant regular bail to the Patna High Court CR. MISC. No.22220 of 2026(4) dt.16-07-2026 3/3 petitioner. 7. Accordingly, the prayer for regular bail of the petitioner is hereby rejected. Brajesh Kumar/- (Ramesh Chand Malviya, J) U
