The instant petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short „BNSS‟) has been filed by the Petitioner / Accused No.9, seeking anticipatory bail in connection with Crime No.21 of 2024 of CID Police Station, Mangalagiri, Guntur District registered for the offences under Sections 409, 420, and 120-B read with Sections 34, 37 of the Indian Penal Code, 18601 and Sections 7, 7(a), 8, 13 (1) (b) & 13(2) of the Prevention of Corruption Act, 1988. 1 for short „IPC‟

Heard Sri S.Sriram, learned Senior Counsel assisted by Madhusudana Sai Ram Asadi, and Sri S.Dushyanth Reddy, learned counsel for the Petitioner and Sri B.Adinarayana Rao, learned Senior Counsel assisted by Sri Sarath Chandra Javvaji, learned counsel for Respondent / SIT. 3. Sri S.Sriram, learned Senior Counsel for the Petitioner would submit that the Petitioner is in Dubai and he will come to India within a week. It is further submitted that the Petitioner will cooperate with the investigation and protection from arrest may be given to the Petitioner so as to enable to the Petitioner to attend before the SIT. 4. Sri B.Adinarayana Rao, learned Senior Counsel for Respondent / SIT would submit that, after registration of case for the alleged liquor scam, the Petitioner fled away to abroad. It is further submitted that a Non-Bailable Warrant as well as Look Out Circular were also issued against the Petitioner. The petition filed by SIT to declare the Petitioner as a “proclaimed offender”, is pending before the trial Court. With a view to avoid arrest in the present crime, he filed the present petition and the Petitioner does not deserve any protection. 5. Considering the submissions made, the Criminal Petition is disposed of.
