GP FOR REVENUE 4 BKM,J W.P.No.13034 of 2026 The Court made the following Order: Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue appearing for the respondent Nos.1 to 5. 2. The issuance of notices to the respondent Nos.6 to 8 is dispensed with as no prejudice would cause to them even if it is disposed of in their absence. 3. This writ petition is filed questioning the order of the 4th respondent dated 06.12.2025 directing the 5th respondent to initiate the necessary action as under:-  Initiate proceedings under the A.P. Assigned Lands (Prohibition of Transfers) Act to resume the lands in Sy.No.108/3A extent Ac.1.47, Sy.No.108/1 extent Ac.1.40, and Sy.No.179 extent Ac.4.77 cents for violation of the "Non- alienation" clause.  Conduct a field inspection to identify the actual persons in possession. If the lands are found to be in the possession of the Appellants/Purchasers (T. Raja Reddy or S. Seshi Reddy), they must be evicted as "unauthorized occupants" as per the law.  Reconcile the discrepancies between the Fair Adangal and Webland, specifically, clarify the status of the Ac.1.00 cent in Sy.No.108/3B currently marked as "Gramakantam" and ensure the 4-Register reflects the current status of the Government's interest in these lands.  Ensure that these survey numbers are correctly notified and updated in the Section 22-A (Prohibited Property) list to prevent any further attempts at registration or encumbrance.  Submit a detailed compliance report regarding the resumption and the updated status of the revenue records to this office within 30 days of receipt of this order. With this the appeal is disposed of accordingly. 4. The learned counsel for the petitioners submits that the petitioners have not violated any conditions of the assignment and basing upon the 5 BKM,J W.P.No.13034 of 2026 unregistered sale documents said to have been executed dated 04.12.2019 and 30.03.2023, the said authority presumed that there is a violation of conditions of assignment. In fact, there is no valid transfer of the assigned land by the assignee. 5. On the other hand, the learned Assistant Government Pleader appearing for the respondent Nos.1 to 5 submits that the petitioners can prefer an appeal before the 2nd respondent under Section 4-A of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977 within 90 days from the date of receipt of the said order. If the petitioners prefer an appeal, the same would be considered by the said Appellate Authority, following the due procedure. 6. In view of the above said facts and circumstances, the petitioners are permitted to prefer an appeal before the 2nd respondent within a period of four (04) weeks from the date of receipt of this order, by enclosing all the necessary documents in support of their claim against the orders of the 4th respondent dated 06.12.2025. On receipt of such appeal from the petitioners, the 2nd respondent shall consider and dispose of the same, strictly in accordance with law, by hearing all the parties concerned, including the petitioners and the respondent Nos.6 to 8, giving due opportunity, upon verification of the records and the subject land, appropriate decision shall be taken on its own merits as expeditiously as possible, preferably within a period of four (04) months thereafter. Pending the enquiry, there shall be an order of 6 BKM,J W.P.No.13034 of 2026 status quo as on today to be maintained with respect to the subject land covered under the impugned order of the 4th respondent dated 06.12.2025. 7. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
