02/02.09.2026 Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with N.D.P.S. Case No.75 of 2026 corresponding to Jugsalai P.S. Case No. 28 of 2026, registered for the offence under Sections 21(c) and 22(c) of the Narcotics Drugs and Psychotropic Substances Act, 1985 and Section 27(b)(ii) of Drugs and Cosmetics Act, 1940 pending in the court of learned Additional Sessions Judge II-cum-Special Judge, N.D.P.S. Act, Jamshedpur.

Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case and false allegation is made that the petitioner was one of the owner of Bolbum Transport Company. He submits that the petitioner was only an employee of the said transport firm and in view of that anticipatory bail may kindly be granted.

Learned counsel appearing for the State opposes the prayer and submits that prayer for anticipatory bail of three of the accused persons has been rejected by the learned Sessions Judge and two of the accused persons namely Satish Kumar and Navneet Kumar Garg @ Navneet Agarwal @ Navneet Agrawal have moved before this court in A.B.A. No.4744 of 2026 and A.B.A. No.4787 of 2026 respectively and their prayer for anticipatory bail has already been rejected. He further submits that all are accomplice and in view of that prayer for anticipatory bail may kindly be rejected.

Considering that 479.60 Kg cough syrup having Codeine Phosphate have been recovered from the said firm namely Bolbum Transport Company and the petitioner is alleged to be one of the owner of the said firm and investigation against this petitioner is still pending and further there are parameters for granting anticipatory bail or regular bail in the matters arising out of Narcotics Drugs and Psychotropic Substances Act and in identical situation prayer for anticipatory bail of two of the accused persons has been rejected by this court in the aforesaid A.B.As., in the attending facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, prayer for anticipatory bail of the petitioner is hereby, rejected.
