Accused in Crime No.140/2026 registered by Suryanagar Police Station, Bengaluru, for the offence punishable under Section 109 of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.140/2026 was registered by Suryanagar Police Station, Bengaluru, for the aforesaid offence against unknown person based on the first information dated 19.04.2026 received from Aiswarya, wife of injured victim - Muruga. During the course of investigation, petitioner herein was arrested on 22.04.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5212/2026 was rejected on 08.05.2026. Therefore, he is before this Court. 4. First information is submitted by the wife of injured victim, who has stated in her first information that on 18.04.2026, at about 09.00 p.m. she was informed by her - 3 - HC-KAR NC: 2026:KHC:32438 CRL.P No. 7336 of 2026 husband's friend that when he, Muruga and other two friends were returning home after having food, a stranger who came in an autorikshaw, all of a sudden assaulted Muruga and went away. Muruga, who had sustained injuries was immediately shifted to a Hospital. First informant went to the said Hospital and after verification, had approached the police and submitted first information based on which FIR was registered against unknown person. 5. During the course of investigation, petitioner was arrested on 22.04.2026. The records would reveal that petitioner got acquainted to the victim through a common friend and it appears that in a road rage, the petitioner and the victim had fought against each other earlier. It is in this background, the petitioner allegedly had assaulted the victim on 18.04.2026. The victim, who had suffered grievous injuries in the said incident was admitted in the Hospital and his medical documents would show that he was discharged on 21.04.2026. Condition of the victim is said to be now stable. It is not in dispute that petitioner has no other criminal antecedents and he is said to be an autorikshaw driver by - 4 - HC-KAR NC: 2026:KHC:32438 CRL.P No. 7336 of 2026 avocation. Major portion of the investigation is already completed. Under the circumstances, the following order:- 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.140/2026 registered by Suryanagar Police Station, Bengaluru, for the offence punishable under Section 109 of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 5 - HC-KAR NC: 2026:KHC:32438 CRL.P No. 7336 of 2026 d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE DN List No.: 1 Sl No.: 58
