JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 4 15-07-2026 Heard learned counsel for the petitioner and learned APP for the State. Perused the case diary. 2. The petitioner seeks bail in connection with Majhauliya P.S. Case No. 193 of 2026 instituted for the offence under Sections 303(2), 317(4), 317(5), 318(4), 319(2), 111(2)(b) of the Bharatiya Nyaya Sanhita, 2023 and Sections 66, 66(c) & 66(D) of the IT Act. 3. The prosecution case, in short, is that on the basis of secret information, the police apprehended the accused persons for operating Mule Accounts used to channel cyber- fraud proceeds, and recovered multiple mobile phones, ATM cards, passbooks, cheque books and other incriminating materials linked to cyber-crime transactions. There is recovery Patna High Court CR. MISC. No.33685 of 2026(4) dt.15-07-2026 2/3 of one mobile phone, 4 ATM cards, 1 SBI passbook etc. from the possession of the petitioner. 4. It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.02.2026. Petitioner bears three (3) criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application. 5. It has been further submitted by the petitioner’s counsel that petitioner has been falsely implicated in the present case. Nothing has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner submits that no any illegal transaction in the name of mule account has been found against the petitioner. Petitioner has no concern with the alleged cyber crime. There is no compliance of Section 103 of the BNSS, 2023. Charge sheet has already been submitted in this case. 6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7. Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner. 8. Let the petitioner be released on bail on furnishing Patna High Court CR. MISC. No.33685 of 2026(4) dt.15-07-2026 3/3 bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Majhauliya P.S. Case No. 193 of 2026, subject to the following conditions: (I) One of the bailors shall be own/close member of the family of the petitioner. (II) The petitioner shall appear on each and every date fixed at the trial.
