Accused No.1 in Crime No.371/2026 registered by Madanayakanahally Police Station, Bengaluru, for the offences punishable under Sections 108 read with 3(5) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.371/2026 was registered by Madanayakanahally Police Station, Bengaluru, against the petitioner and another for the aforesaid offences based on the first information dated 09.04.2026 received from Lingamma, mother of deceased Raghunandan Gowda, who is the husband of the petitioner herein. Apprehending arrest in the said case, petitioner had filed Crl.Misc.No.927/2026 before the jurisdictional Sessions Court which was dismissed on 16.05.2026. Perusal of the material on record would go to show that marriage of the petitioner with deceased Raghunandan Gowda was solemnized about 15 years prior to the alleged date of incident and from the said wedlock, they have two children aged about 12 years and 9 years respectively. In the first information, it is mentioned that for the last 3 months, petitioner and her husband were fighting against each other on petty issues and on 07.04.2026, they had fought in the matter of petitioner's mangalasutra and on the said date, petitioner allegedly had gone to her sister's house and had stayed there. Raghunandan subsequently, had committed suicide in his house by hanging himself. Immediately thereafter, police were summoned and a UDR case was registered. After two days from the date of death, mother of the deceased had approached the police stating that deceased had left behind a death note stating that petitioner and her boyfriend were the cause for the death of her son. 5. Learned counsel for the petitioner has produced certain documents before this Court, which would go to show that deceased was facing some serious health conditions and he was - 4 - HC-KAR NC: 2026:KHC:32435 CRL.P No. 7303 of 2026 also admitted in a rehabilitation Centre in the month of February-March, 2024. Petitioner is a married lady having two minor children. She has undertaken to co-operate with the police for the purpose of investigation. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively. Accordingly, the following order:- 6. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.371/2026 registered by Madanayakanahally Police Station, Bengaluru, for the offences punishable under Sections 108 read with 3(5) of BNS, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. - 5 - HC-KAR NC: 2026:KHC:32435 CRL.P No. 7303 of 2026 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witnesses and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
