1. Heard Mr. Mukherji, learned Senior Counsel for the Petitioner and Ms. Padhi, learned ASC for the State.
2. It is submitted on behalf of the Petitioner that the Opposite Parties are proceeding for eviction of the Petitioner without giving him any opportunity of hearing and without following due process of law.
3. Accordingly, the writ petition is disposed of at the stage of admission with a direction to the Executive Officer, NAC, Nimapara (O.P.No.3) to grant due opportunity of hearing to the Petitioner before proceeding for his eviction and take decision, in accordance with law, within a period of six weeks from the date of receipt of certified copy of this order along with a copy of the writ petition.
