By way of filing the instant criminal misc. petition, a prayer has been made for issuing directions to the Investigating Officer for conducting fair and impartial investigation in FIR No.748/2020 registered with Police Station Kaman, District Bharatpur for the offence under Section 376-D IPC. 2. At the outset, the learned Public Prosecutor has apprised the Court, on the basis of a factual report dated 22.10.2021 furnished by the Station House Officer, Police Station Kaman, District Bharatpur, that upon investigation, the police found that no case is made out and has proposed a final report negative on 03.03.2021, [2026:RJ-JP:16431] (2 of 2) [CRLMP-952/2021] hence, under these circumstances, no cause of action survives with the petitioner to continue with this petition and the same has become infructuous. 3. Considering the above factual aspect of the matter, the instant criminal misc. petition is dismissed as having become infructuous. The stay application and all pending applications, if any, also stand dismissed. 4. However, the petitioner would be at liberty to avail the remedies available to him under the law. 5.
