1. Heard. 2. The petitioner has filed the instant petition for following reliefs:-
“10.1 That the Hon’ble Court may kindly be pleased to call for the entire record pertaining to the instant case, in the interest of justice. 10.2 That, the Hon’ble Court may kindly be pleased to allow this petition and set aside the notice dated 01.05.2026, 04.05.2026, 07.05.2026 (Annex.P/1 (colly) and the memo dated 13.05.2026 (Annex P/3) sent by Tahsildar to SHO Arjunda. 10.3 That the Hon’ble Court may kindly be pleased to direct the Gram panchayat to consider grant of patta in respect of the building constructed by Sahu Samaj for social activities. 10.4 That, the Hon’ble Court may kindly pass any order deem fit in the interest of justice.”

Brief facts of the case are that the petitioner submits that the Sahu Samaj had constructed a community Bhawan approximately 20 years ago on Government land bearing Khasra No. 650 for carrying out its social and religious activities. It is alleged that, without any resolution of the Gram Panchayat, the Sarpanch and the Secretary issued notices dated 01.05.2026, 04.05.2026 and 07.05.2026 (Annexure P/1 colly) directing removal of the construction. Thereafter, by a joint communication (Annexure P/2), they requested the Tahsildar, Tahsil Arjunda, to provide magisterial and police assistance for removal of the construction on
19.05.2026. 4. Learned counsel for the petitioner submits that notices for eviction has been sent to the petitioner by the concerned Gram Panchayat
3 on 01.05.2026, 04.05.2026 and 07.05.2026 for removal of encroachment and illegal construction raised by the petitioner.
He further submits that the notices are not in accordance with law, as such this petition has been filed. 5. Learned counsel for the State submits that upon notices, the petitioner has rushed to the Court without replying to the notices before the competent authority in accordance with law. 6. Considering the submissions made by learned counsel for the parties and without expressing any opinion on the merits of the case, this Court deems it appropriate to grant the petitioner one week’s time from today to submit a reply to the impugned notices before the concerned Gram Panchayat. Upon receipt of such reply, the Gram Panchayat shall consider and decide the same, in accordance with law, by passing a reasoned order within a period of 10 days thereafter. Till the expiry of the said period of 10 days, no coercive steps shall be taken against the petitioner for removal of the alleged encroachment or the construction in question. 7. With this observation and direction, the petition stands disposed of. Sd/-
