PUBLIC PROSECUTOR 2 The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.,’)/Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) seeking to quash the proceedings against the Petitioner/Accused in Cr.No.69 of 2023 dated 07.04.2023 on the file of Buttaigudem Police Station, Eluru District. 2. Heard learned counsel for Petitioner and the learned Assistant Public Prosecutor. 3. On perusal of the record, it is observed that the crime was registered in the year 2023. The investigation reveals that the case is false in nature. However, the Investigating Officer has not filed appropriate proceedings before the learned jurisdictional Magistrate, despite permission having been granted by the Sub‑Divisional Police Officer to refer the case as false. 4. Having regard to the facts and circumstances of the case, Respondent No. 1 is directed to file appropriate proceedings before the learned jurisdictional Magistrate within a period of two (02) weeks from the date of receipt of this order. 5.
