Report submitted by the State be kept with the record. Learned advocate for the petitioner submits that the petitioner was initially granted bail on or about 21.02.2022, but, subsequently, he was absent, as such, warrant of arrest was issued. On execution of such warrant of arrest, the petitioner was taken into custody and the petitioner is in custody since 06.05.2022, i.e., for a period of three years eight months. Learned advocate for the State opposes the prayer for bail and submits that the petitioner is the principal 2 accused and he has antecedents relating to similar offences under the Arms Act. I have taken into account the period of detention and the initial observations made by the learned Magistrate in the order dated 21.02.2022. Having considered the period of detention subsequently and the fact that only one witness has been examined-in-part out of the 19 witnesses proposed to be examined, I am of the view that further detention of the present petitioner is unwarranted. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Sujoy Patra @ Bachha shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned ACJM, Barrackpore. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Trial Court and shall not leave the jurisdiction of ACJM, Barrackpore without prior intimation to the learned trial court. Additionally, the petitioner shall once in a fortnight meet with the Officer-in-charge of Ghola Police Station. 3 If there are any violations of the aforesaid conditions, the learned trial court would cancel the bail of the present petitioner without further reference to this court. Accordingly, CRM(M) 2357 of 2025 is allowed. Pending application(s), if any, is also disposed of.
