1. Heard the learned counsel appearing on behalf of the petitioner.

Learned counsel for the petitioner submits that the petitioner is in custody since 25.10.2025 in connection with POCSO Case No. 84 of 2025 arising out of Borio P.S. Case No. 75 of 2025, registered for offence punishable under Section 64 (1), 65 (1), 70 (2) 61 (2) of the BNS and Section 4 & 6 of POCSO Act, however charges framed under section 137 (2)/ 3 (5), 87/ 3 (5), 70 (2), 351 (2) of the BNS and under section 6 read with 5 (g) of POCSO Act, pending in the court of learned Special Judge (POCSO), Sahibganj.

Learned counsel for the petitioner has submitted that the case is running at the stage of evidence. He has also submitted that the victim and her mother have already been examined. Learned counsel has further submitted that co-accused namely Roben Murmu has been enlarged on bail by co-ordinate bench of this Court in B.A. No. 2089 of 2026 vide order dated 17.03.2026 on the ground that it was Nishan Murmu who had established physical relationship with the victim.
Learned counsel for the petitioner has submitted that the case of the petitioner stands on an identical footing.
4. After hearing the learned counsel for the petitioner and considering the fact that the victim as well as her mother have already been examined and further, in view of the fact that a similarly situated

accused person has been enlarged on bail by co-ordinate bench of this court, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (POCSO), Sahibganj in connection with POCSO Case No. 84 of 2025 on the following conditions: (i) The petitioner shall not disturb the victim or her family member in any manner whatsoever. If such incident happens, the victim/her family member may approach the concerned court for cancellation of the bail of the petitioner. (ii) One of the bailors would be the close relative of the petitioner. (iii) The petitioner will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bond furnished by the petitioner. (iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court. (v) The petitioner shall fully co-operate with the proceedings before the learned court below.
5. The instant bail application is allowed with the aforesaid conditions.
